Last Updated: January 26, 2025
1. Introduction
GeloCale.com ("we," "our," or "us") respects the intellectual property rights of others and expects its users and visitors to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines the process for notifying us of copyright infringement, as well as how to file a counter-notice if any material you have posted is removed.
By using GeloCale.com ("Website"), you agree to comply with this DMCA Policy and all applicable laws and regulations.
2. Personal Use Only
Any digital products or content made available through GeloCale.com are intended for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material except for personal use, unless expressly permitted in writing by us or the copyright holder.
Unauthorized use of our digital products, including resale, public distribution, or any use contrary to the stated purpose, may violate copyright, trademark, or other laws and could lead to legal action.
3. Reporting Claims of Infringement
If you believe that any content on our Website infringes upon your copyright, you or your authorized agent may submit a notification of claimed infringement under the DMCA. Your notification must be in writing and include all of the following information:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
- Identification of the copyrighted work or works claimed to have been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list.
- Identification of the material that is claimed to be infringing, including reasonably sufficient detail to enable us to locate it on our Website (e.g., a URL or specific section of the Website).
- Your contact information — such as an address, telephone number, and email address — so that we may contact you regarding your claim.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Please send your notification to our designated Copyright Agent at:
Email: hello@gelocale.com
Important Note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Do not make false claims.
4. Counter-Notification
If your content has been removed due to a DMCA takedown notice, and you believe that such removal or disabling is a result of mistake or misidentification, you may submit a counter-notification. Your counter-notification must be in writing and include the following:
- Your physical or electronic signature.
- Identification of the removed or disabled material and the location where the material appeared before it was removed or disabled.
- A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court in your judicial district (or if you are outside the United States, the jurisdiction of the federal courts located in [the jurisdiction in which GeloCale.com is located]) and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Please send your counter-notification to our designated Copyright Agent at:
Email: hello@gelocale.com
If we receive a valid counter-notification, we may forward it to the party who submitted the original notification. Unless the copyright owner files an action seeking a court order against the user who posted the allegedly infringing material, we may restore the removed or disabled material in accordance with the DMCA.
Important Note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability for damages.
5. Repeat Infringers
We maintain a policy of terminating, in appropriate circumstances, users who are deemed repeat infringers. We may also limit access to the Website and/or terminate the accounts of any users who infringe any intellectual property rights, whether or not there is any repeat infringement.
6. Modifications
We reserve the right to modify this DMCA Policy at any time. When we do, we will post the updated policy on this page, and the revised policy will apply only prospectively. Please check this page frequently for updates.
